LESSON for October 9, 2018 – GLOATING and CONSPIRING!

 

We were going to get around to the premise that the Broadway hit “Hamilton”, presumed to be a liberal celebration of multicultural diversity, was/is, in fact, an alt-right rant as glorifies an alt-right icon (who bears an ideological, if not physical, similarity to an out-of-favor political operative) and the altar-right Federalist President who is the uncanny progenitor of a certain current occupant of the White House… honest, we were.

Something intervened.  Shit happened.

And because it’ll take another week to scrape off our boots, we intend to push back the matter of Messrs. Hamilton, Miranda and Bannon.  Hopefully to next week.  Hopefully.

In the meantime, there was the matter of Kavanaugh v. Blasey-Ford, of which it can be said that all is over save the shouting and there was and will be plenty of shouting between now and the midterm elections (and probably, for some forty-some years thereafter).

The denouement followed a predictable path first hacked out of the brush in November, 2016… the Republicans, the donor class and the mindless mob as first supported them out of hope and now continues to do so out of shame tapped the kegger and partied while the Democrats, traditional losers, whined and wept and concocted schemes of revenge.

Same old same old.

The widely anticipated FBI investigation of the nominee proved a bust… a disappointing secret fiasco of which it is mainly known that neither of the principals was summoned to a little room and questioned by government agents as presumably have experience and expertise in extracting the needle of truth out of a haystack of lies and excuses.  Once it became widely known that the architecture of the investigation would not be set by the Febbies but, rather, by President Trump, the uselessness of Jeff Flake’s ignoble gesture stood naked in the elevator as the principles, retiring Senator Flake and Democratic patsy Chris Coons (D-De) threw up their hands and voted their party lines.

Until jetting off to retirement in Arizona to contemplate the ruins of his career (Democrats blame him for the vote and for the insipid inquiry; Republicans despise him for prolonging the matter in the first place), Flake would do well to hereafter take the stairs when entering or exiting tall buildings and for hiring bodyguards… POTUS is still mad enough at him to preclude the involvement of the Secret Service… who will shield the Arizonian from angry, screeching rape victims.  (Note how the politically correct and squeamish media have favored the term “sexual assault” over “rape” – and, for that matter, have substituted “survivors”… as connotates another reality show episode… for “victims”, as brings to the fore the criminal nature of the incident.)

His deceased and departed colleague, John McCain, was a vigorous and partisan Republican but, when presented with a toxic “repeal but don’t replace” healthcare measure, he simply raised a fist and then turned it… thumbs down.  But Flake was no John McCain.

The FBI rendered irrelevant, Senate Majority Mitch McConnell (R-Ky) rushed to judgment in a 4 PM Saturday when most of the old-guard Republicans were asleep and the new Populist right was watching football.  Although the deal was struck when Susan Collins (R-Me) cast her lot for Brett, the reassuring presence of Vice President Pence to break any deadlock caused Sen. Joe Manchin (D-WV) to support on the well-calculated presumption that the electoral gains from the Old Deal donkeys who had been backing Trump would offset any female defections from the tiny Democratic base.

These, unsurprisingly, have nowhere to go (clueless libertarians, Russia-colluding Greens, “special” write-in candidates?) and Djonald Unchained is giddy with anticipation, crowing that[Democrats’] rage-fueled resistance is starting to backfire at a level nobody’s ever seen before,” at a Minnesota rally.

The pro-Trump Washington Times’ polling suggests pro-Kavanaugh sentiment has helped close the Republicans’ enthusiasm gap with Democratic voters, and several Republican Senate campaigns said they are seeing big boosts in their races to unseat Democratic incumbents, particularly in North Dakota, where incumbent Heidi Heitkamp “now trails by double digits in her re-election bid against Rep. Kevin Cramer, her Republican challenger. Voters tell pollsters they are prepared to punish Ms. Heitkamp,” for her vote against Kavanaugh.

Indeed, the midterm election cycle apparently spins on which candidate the voters want to punish, rather than promote.  Manchin may pick up a few purplish West Virginians as gave Trump an overwhelming majority, but will women flip and vote for his opponent, Patrick Morrissey (or, more likely, just stay at home)?  Asked about former Alaska Gov. Sarah Palin's (R) tweet in which she said "I can see 2022 from my house..." and if she could pose a primary threat to the renegade Murkowski, Trump responded, "I don't know anything about that. It's four years. That's a long time. But they will not forget. They will never forget. What she did was unacceptable. Really unacceptable."

If the bitterness will last for 4 years, why not 2... Collins’ decision has already caused an eruption of rats from the walls.  Novelist Stephen King urged Collins to vote no when Kavanaugh's nomination came to the floor.  "Susan Collins says she will vote to confirm Kavanaugh, partially because the man who lied repeatedly in his confirmation hearings told her he considered Roe 'settled law.' Senator Collins, there is still time to change your mind and do the right thing."

She didn’t.

Will King seek the Democratic nomination in 2020?  Congress is already a horror-show... why not staff it with experts?

The sore losers are loading their rifles (with gluten-free, artisan bullets?) and trying not to seem to be jumping said guns.

New Jersey Sen. Cory Booker said on Sunday the possibility of impeaching Supreme Court Justice Brett Kavanaugh shouldn’t be off the table if Democrats take one of the houses of Congress in next month’s midterm elections.  Other Democrats have also raised the possibility of impeaching Kavanaugh over allegations that he committed perjury in his hearing at the Senate Judiciary Committee, on which Booker sits.

But not so fast…

“The reality is, right now, Republicans control the House and the Senate, and there’s no way to do even an investigation unless we flip one of the houses. So I think even before you start focusing on questions about his truthfulness before a Senate committee, you’ve got to focus on the urgency of the work over the next 30 days, and that’s where my focus is,” Booker told Yahoo News.

The sore winner… well, he had vowed, on the Senate floor, to make Democrats “reap the whirlwind” over the next forty years by, presumably, discarding precedent, the law and the Constitution, and wielding his vote as a club with which to punish his adversaries (women, sexual and racial minorities, the poor and working classes, Mother Nature, immigrants, foreigners, the media, Hollywood etc. etc.)took to the friendly confines of the Wall Street Journal and asked us to consider kinder, gentler days.

He hearkened back to the night of his appointment, July 9th, where he had said “a good judge must be an umpire—a neutral and impartial arbiter who favors no political party, litigant or policy.”  Did he walk this back after a confirmation process roundly excoriated on both sides of the aisle?  Of course not.

“I do not decide cases based on personal or policy preferences,” he wrote in the WSJ, citing his twelve years experience on the Federal bench. “I am not a pro-plaintiff or pro-defendant judge. I am not a pro-prosecution or pro-defense judge. I am a pro-law judge.

“As Justice Kennedy showed us, a judge must be independent, not swayed by public pressure. Our independent judiciary is the crown jewel of our constitutional republic. The Supreme Court is the last line of defense for the separation of powers, and for the rights and liberties guaranteed by the Constitution.

“The Supreme Court must never be viewed as a partisan institution. The justices do not sit on opposite sides of an aisle. They do not caucus in separate rooms. As I have said repeatedly, if confirmed to the court, I would be part of a team of nine, committed to deciding cases according to the Constitution and laws of the United States. I would always strive to be a team player.”

And the whirlwind?

“I might have been too emotional at times,” Kavanaugh allowed.  “I know that my tone was sharp, and I said a few things I should not have said. I hope everyone can understand that I was there as a son, husband and dad. I testified with five people foremost in my mind: my mom, my dad, my wife, and most of all my daughters.”

Who, one hopes, shall never have to be put in the position of Ms. Blasey-Ford.  (See text of the full article as Attachment One.)

Comparing the two most recent controversial confirmations, USA Today noted that Justice Clarence Thomas had responded to public hostility “with a smoldering sense of grievance and alienation. It will be an immense challenge for Kavanaugh not to do the same.”

CNN News called his mea culpa a “performance” that caused lifelong Republican former Supreme Court Justice John Paul Stevens to change his views on Kavanaugh's suitability for the highest court. Stevens said Thursday that he had changed his mind for reasons that have "really no relationship to his intellectual ability or his record as a federal judge," and added that "he's a fine federal judge."

"But I think that his performance during the hearings caused me to change my mind," the retired justice said.

But LifeZette (Drain the Swamp, Border Security, Midterms 2018, Traditional Values, Constitutional Freedoms, Liberal Hypocrisy (presumably against) and More) declared that Hollywood Liberals were melting down after Brett Kavanaugh’s confirmation to the Supreme Court.

“This is no surprise, since they’ve been so aggressive in their opposition to the man — but it’s still incredible to observe how extreme they’re willing to be in their effort to keep their party’s holier-than-thou narrative going.”

“One by one, each of CBF’s claims are blowing up, and it’s looking more and more like her case against Kavanaugh was a setup,” posited Red State on the basis of a CNN transcript of Blasey Ford’s response to Senate Judiciary Committee prosecutor Mitchell, stating that she had prepared her letter to Diane Feinstein in Rehoboth, Delaware.

“Could it be that this fragile, childlike, 51 year old woman, whom we all must believe, was acting? The theory that CBF was simply the face of a deliberate plan by liberal activists led by her life long friend, former FBI special agent Monica L. McLean, is starting to gain traction.

“This is the same Monica McLean (of Rehoboth, aha!) who CBF once allegedly coached prior to an FBI preemployment polygraph test. McLean passed her test and remained with the FBI for 24 years, retiring in 2016.”

Far from deep-sixing the incumbents’ advantage in both House and Senate, the conservative media celebrating the victory predicted a Red Tide sweep in November.

Mr. Trump’s nomination of Mr. Kavanaugh is a credit to the process he established to win the election and govern with conservative support,” swaggered Breitbart.  “He sought the help of legal elites on the right, led by the Federalist Society, who compiled an impressive list of potential nominees. This isn’t a rogue judicial operation to choose presidential cronies. It is the gold standard for legal talent that believes in the original meaning of the Constitution. It’s hard to see how any GOP President would have done better, and others have done much worse.”

“Look at the polls over the last three or four days,” the President Trump said at a rally in Minnesota. “It shows [Democrats’] rage-fueled resistance is starting to backfire at a level nobody’s ever seen before. We love it.”

Polling suggests pro-Kavanaugh sentiment has helped close the Republicans’ enthusiasm gap with Democratic voters, according to the Washington Times, and several Republican Senate campaigns said they are seeing big boosts in their races to unseat Democratic incumbents.

“That may be particularly true in North Dakota, where Ms. Heitkamp now trails by double digits in her re-election bid against Rep. Kevin Cramer, her Republican challenger. Voters tell pollsters they are prepared to punish Ms. Heitkamp if she votes against Judge Kavanaugh.”

Heitkamp went ahead and voted “no”, and will presumably now reap the whirlwind. “If it was a political decision for me, I would certainly be deciding this the other way,” she said. “I can’t get up in the morning and look at the life experience I’ve had and say ‘yes’ to Judge Kavanaugh.”

Others may not be so isolated or vulnerable or will face the wrath of the sore winners during the primary seasons of elections soon to come.

As usual, thousands of demonstrators took to the streets and to various Washington landmarks to protest… most anti-Kavanaugh, some protesting the protestors.  As has been the usual case since Charlottesville, nobody was killed; hundreds were arrested but nobody is getting hard time.  (See a right-wing compilation of protestors’ protests as Attachment Two.)

Foreigners simply shook their heads over the crazy Americans and consoled themselves with history (or herstory, as it were).  Right-wingers reminded their base of the borking that had been dished out to Robert Bork back in the day.  CBC Canada was not the first, nor the onliest to dredge up the Clarence Thomas/Anita Hill kerfuffle.  “The dramatic and emotional testimony heard Thursday at the U.S. Senate judiciary committee drew comparisons to a similar hearing years ago, when another Supreme Court nominee was facing questions about alleged sexual misconduct.”  See Attachment Eight.  More at https://www.cbc.ca/news/world/kavanaugh-ford-thomas-hill-1.4841559

CNN scanned the globe for reactions, finding that most of them were not pretty.  Kavanaugh “did himself no favors” was their verdict.

 

 

While the elite and the cognoscenti were pondering the latest developments and implications of the Kavanaugh confirmation, Don Jones was enjoying himself contemplating another tumble in the unemployment rate.  At 3.7% (not counting, of course, the impact of full-time workers reduced to part-time jobs, the presence of those not in the workforce and the possible fudging of statistics), the official unemployment rate was the lowest since 1969.  President Trump, not surprisingly, took credit for the decline and vowed that it would lead to a red tide in November (as distinct from the red tide fouling Florida’s beaches with dead fish).

The magnitude of employment gains was sufficient to wholly override the plummeting balance of trade – imports were up and exports were down.  A lot.  Federal revenues were also down… a lot… quite a rarity in the current economy.  Gas prices are up and, once Hurricane Mike has its way with the oil platforms in the Gulf, they are likely to worsen.  On the other hand, the predicated devastation will lead to a lot of construction jobs… maybe auguring a drop to 3.6, even 3.5%,
